Sierra Health Foundation is committed to protecting the privacy of its website users through our compliance with this privacy policy (this “Policy”).

This Policy describes the types of information we may collect from you or that you may provide to us when you visit our websites, https://www.sierrahealth.org and https://www.shfcenter.org (our “Platform”), and our practices for collecting, using, maintaining, protecting and disclosing that information.

This Policy applies to information we collect through our Platform and in email or other electronic messages between you and our Platform. It does not apply to information collected by us offline or through any other means, including on any other website operated by us (which may be subject to a separate privacy policy), or by any third party, including through any application or content that may be accessible from our Platform. When you click on links on our Platform, they may direct you away from our Platform. This Policy does not apply to and we are not responsible for the content or privacy practices of third party websites, including websites reached by such links, and we encourage you to read their privacy policies. Once you leave our Platform or are redirected to a third-party website or application, you are no longer governed by this Policy or any applicable Terms of Use.

Please read this Policy carefully to understand our policies and practices regarding your information and how we will treat it. By accessing or using our Platform, you agree to the terms and conditions of this Policy, as may be amended from time to time by our update of this webpage.

1. Information Collection

We will only collect and process information about you where we have a lawful basis, which may include where you have given us your consent, where the information is necessary for the processing of donation(s) you have submitted through our Platform, and for other legitimate interests specified in this Policy. Where we are relying on your consent to process personal information, you have the right to decline or withdraw your consent at any time by notifying us in the manner provided in Section 12, and where we rely on other legitimate interests, you have the right to object.

We collect several types of information from and about users of our Platform, including information (i) by which you may be personally identified, such as your first and last name, physical address, phone number, email address and other personally identifiable information (“Personal Information”), and (ii) that is about you but does not individually identify you.

This information is collected when you provide it to us, and may also be automatically collected through data collection technologies.

a. Information Provided by You

We collect information from you through our Platform, including (i) information that you provide through filling out our online forms, including the mailing list and electronic newsletter sign-up forms, conference center applications, and user-group registration forms, (ii) records and copies of your correspondence (including email addresses) if you contact us with general inquiries or requests for further information, and (iii) details of donations or other transactions you carry out through our Platform.

b. Automatically Collected Information

As you interact with our Platform, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions and patterns, including information regarding your visits to our Platform such as traffic data, location data, logs, and other communication data, and information about your computer and internet connection such as your IP address, operating system, and browser type.

We may also use these technologies to collect information about your online activities over time. Although your browser or device may include “Do Not Track” functionality, our Platform currently does not respond to a “Do Not Track” signal from our browser or device. Accordingly, our information collection and disclosure practices, and the choices we provide to users, will continue to operate as described in this Policy, whether or not a “Do Not Track” signal is received.

The information we collect automatically is only statistical data and does not include Personal Information. The technologies we use for this automatic data collection may include:

i. Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting, you may be unable to access certain parts of our Platform. Unless you have adjusted your settings so that your browser will refuse cookies, our system will issue cookies when you direct your browser to our Platform.

ii. Web Beacons. Parts of our Platform may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited our Platform and for other related Platform statistics (for example, recording the popularity of certain Platform content and verifying system and server integrity).

iii. Server Logs and other Technologies. We may collect many different types of information from server logs and other technologies. For example, we may collect information about the device you use to access our Platform, your operating system type, browser type, domain, and other system settings, as well as the language your system uses and the country and time zone where your device is located. Our server logs also record the IP address of the device you use to connect to the Internet. An IP address is a unique identifier that devices require to identify and communicate with each other on the Internet. We may also collect information about the website or application you were visiting before you came to our Platform and the website or application you visit after you leave our site. These tools help us improve user experience on our Platform.

2. Information Use

We use information that we collect about you or that you provide to us, including Personal Information: (i) to provide you with information that you request from us by email or other means, (ii) to fulfill any other purpose for which you provide information, (iii) in any other way we may describe when you provide the information, and (iv) for any other purpose with your consent.

3. Online Donations

Our online donation center through our Platform utilizes third party hosting, licensing and payment partners that allow us to accept online donations for our mission and/or to provide any products or services to you. Your information is stored through these databases and applications on a secure server behind a firewall. If you choose a direct payment through our Platform to complete your donation (or purchase, if applicable), then our partners will store your credit card data. Such financial data is encrypted through Transport Layer Security (TLS) technology. In general, the third party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies with respect to the information we are required to provide to them for your donation and purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers. In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than you or us. If you elect to proceed with a transaction that involves the services of a third party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

4. Disclosure of Information

We do not disclose aggregated information about our users, regardless of whether such information identifies any individual, to third parties except to Google and its wholly owned subsidiaries through Google Analytics consistent with its Terms of Service located at https://marketingplatform.google.com/about/analytics/terms/us/.

We do not disclose or share your Personal Information to anyone, including to third parties, other than (i) to our subsidiaries and affiliates, (ii) to contractors, service providers, and other third parties we use to support our mission, (iii) to fulfill the purpose for which you provide the information, (iv) for any other purpose disclosed by us when you provide the information, or (vii) with your consent.

We may also disclose your Personal Information (i) to comply with any court order, law or legal process, including to respond to any government or regulatory request, (ii) to enforce or apply any applicable Terms of Use and other agreements, or (iii) if we believe disclosure is necessary or appropriate to protect the rights, property or safety of Sierra Health Foundation or others, which includes exchanging information with other companies and organizations for the purposes of fraud protection.

5. Choices About How We Use and Disclose Your Information

We allow users who have submitted Personal Information on our Platform the following choices regarding the use and disclosure of such information:

a. Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.

b. Mailing List. If you have signed up for our Mailing List through our Platform, you may update previously submitted information or opt out of receiving future emails from us by using the Mailing List link on our home page or by contacting us directly (see Contact Information below). Please note that we may not be able to accommodate every request to change information, including in the event we believe the change would violate any law or legal requirement.

Although we do not currently respond to “Do Not Track” signals, marketing partners we may engage from time to time may be members of the Network Advertising Initiative (“NAI”) or the Digital Advertising Alliance (“DAA”), which have agreed to honor consumers’ opt-out preferences submitted through those organizations’ websites. 6. Age of Consent; Your Consent and Rights

Our Platform is not targeted at children. By using our Platform, you represent that you are at least the age of majority in your country, state or province of residence, or that you are the age of majority in such jurisdiction and you have given us your consent to allow any of your minor dependents to use our Platform. If you are under the age of majority in your country, state or province of residence and we do not have your parent or guardian’s consent to your use of our Platform, do not use or provide any information on or Platform or through any of its features or provide any information about yourself to us, including your name, address, telephone number, or email address.

If we learn we have collected or received Personal Information from a child under the applicable age of majority without verification of parental consent, we will delete that information. In the event you change your mind and wish to withdraw your consent for our use or your information or consent to your minor dependents use of our Platform, or if you believe we might have any information from or about a child under the applicable age of majority and such consent has not been provided, please contact us immediately by sending an email to info@nullsierrahealth.org (subject, “Privacy Compliance”) or by mail to the address in Contact Information, below.

7. Phishing or False Emails

If you receive an unsolicited email that appears to be from us that requests Personal Information or that asks you to verify or confirm your Personal Information by clicking on a link that email was likely sent by someone trying to unlawfully obtain your information, sometimes referred to as a “phisher” or “spoofer.” We do not ask for this type of information in an email. 8. Your California Privacy Rights

If you are a California resident, California law may provide you with additional rights regarding our use of your Personal Information.

California Business and Professions Code Section 22575, et seq. requires an operator of a commercial website or online service that collects personally identifiable information about individual consumers residing in California who use or visit its website to conspicuously post a privacy policy on its website. To the extent we are subject to the above code section, this Policy is intended to satisfy its requirements with respect to our California users.California’s “Shine the Light” law (Civil Code Section § 1798.83) may permit users of our Platform who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. If you are a California resident: (i) under the age of 13, a business must obtain the prior authorization of your parent or guardian before selling your personal information; or (ii) age 13 to 16, a business must obtain the prior authorization of either you or your parent or guardian before selling your personal information.

9. Data Security

We have implemented reasonable technical and organizational measures designed to protect your Personal Information from accidental loss and from unauthorized use, alteration and disclosure. While we believe the measures implemented on our Platform reduce our vulnerability to security problems to a level appropriate to the type of information involved, the safety and security of your information also depends on you. You should, among other actions, (i) exit from our Platform when you are not using it, (ii) maintain good internet security, and (iii) immediately change passwords to any email address provided to us that you think may be compromised and notify us as soon as possible. Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to our Platform. Any transmission of your Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on our Platform.

In the event of a data breach on our Platform, Sierra Health Foundation will promptly notify its users following receipt of notice of the breach from our web host. Such user notification may be provided by a posting in the News section of our Platform or by any other reasonable method determined by us.

10. Data Retention

Sierra Health Foundation is located in the United States. By submitting your information through our Platform, you agree to the transfer, storing and processing of your information, which, depending on the use of third-party services, may be transferred, processed and stored outside of the country where you reside. When you visit our Platform to make a donation or place an order for our products services, if applicable, we will take reasonable steps to ensure that your information is treated securely and in accordance with this Policy. We will maintain your information until such time we receive instructions from you to remove or delete your information in accordance with this Policy, or until such earlier date as we decide to delete the information. We will take all reasonable steps to dispose or arrange for the disposal of customer records within our custody or control containing your Personal Information following the above period by shredding, erasing, or otherwise modifying such Personal Information to make it unreadable or undecipherable through any means, as applicable.

It is our policy to post any changes we make to this Policy on this webpage. The date this Policy was last revised is identified at the bottom of this webpage. You are responsible for periodically visiting our Platform and this Policy to check for any changes.
